Family of man shot dead by security guard in North Portland sues for $25M

PORTLAND, Ore. (KATU) — The family of a man shot and killed in a Lowe's parking lot nearly five months ago has filed a $25-million wrongful death lawsuit.
The family says the security guard that shot Freddy Nelson Jr. wasn't certified to carry a gun.
The family's attorney, Tom D'Amore said this tragedy could have been prevented, and he's hoping this lawsuit will instigate change within the security guard industry.
The 14-page complaint that was filed Tuesday in Multnomah County points the finger at the development company, the property owner, and the security group that hired armed security guards.
The wrongful death lawsuit says the defendants should have known the guards weren't certified to carry guns.
Nelson, 49, was shot by the security guard May 29.
The court document states he was sitting in his vehicle in the Lowe's parking lot in North Portland with his wife in the passenger seat.
The medical examiner ruled his death a homicide.
As KATU reported earlier, the security guard stayed at the scene and was interviewed by detectives.
No criminal charges have been filed.
In state records obtained by KATU, the security guard said he shot at Nelson in self-defense.
Nelson’s wife is seeking $10 million alone for severe and traumatic emotional distress.
KATU reached out to Cornerstone Security for a response and it said, "no comment."
The Multnomah County district attorney is reviewing the case.
